Mussington says matter challenging Barbuda airport construction will be heard at Privy Council shortly

Barbudans are heading to the Privy Council, once again, to challenge
the actions of the Central Government – this time, regarding the
construction of an international airport on the sister-island.
 
Councilman John Mussington was one of two people who had
challenged the construction about five years ago, based on several

factors, including environmental issues. Jacklyn Frank was the other
interested party.
 
Mussington says there will be a “major hearing” on November 8
before the Privy Council in England.
 
He explains that the primary case was one for a judicial review of
the Physical Planning Act and of the roles of the Airport Authority
and the Development Control Authority in facilitating the
environmental destruction that enabled the airport construction.
 
Mussington says the upcoming hearing before the country’s highest
court has to do with an injunction that their lawyers tried to file, but
were denied.
 
He says the lawyers representing the Government are making the
argument that, as ordinary/private citizens of Barbuda, Mussington
and Frank do not have the right to question the actions of the
Administration.

The team, according to Mussington, will leave for London around
November 2. Prior to that, it will share information with the public,
highlighting the implications of this legal fight, he says.
