‘Tek dat!’ expresses Mussington’s feelings about Privy Council win that vindicates him and Frank

Plain and simply said, “Tek dat” is what an elated John Mussington
had to say about Tuesday morning’s Privy Council ruling that allows
his and Jacklyn Frank’s appeal of the Barbuda airport case.
 
Mussington, a marine biologist and environment activist, and Frank,
a former teacher, had appealed a decision of the Eastern Caribbean
Supreme Court of Appeal, which had ruled they had no locus standi
to challenge the Government on the construction of an airstrip.
However, the country’s highest appellate court says the Court of
Appeal erred in its decision.

Mussington says this ruling has many implications, and the
Barbudans will be looking at how to proceed with their claim.
 
In the meantime, he was full of praise for the legal team that
represented him and Frank, pro-bono, and for the Global Legal
Action Network (GLAN) for its continued support in this fight.

Meanwhile, a relieved Frank says she had no doubt that the Privy
Council would rule in their favour.
 
This matter has been going on for some five years, but it is not the
end, she notes.


However, this ruling demonstrates that the Barbudans have a right
to challenge the Government – or anyone else who seeks to create
confusion with regard to their land rights, she says.  
 
Accordingly, other instances of environmental destruction that are
taking place on Barbuda will be challenged, since this ruling gives
them the authority to do so.

What is taking place now, with regard to the airport and how it has
been set up, brings apartheid to mind, Frank says.
She adds that the Browne Administration is being led by greed and
the love of money, which will not last.
